What is a Will & Why Should You Register It?

A Will (also called a Last Will and Testament) is a legal declaration made by a person — the testator — specifying how their assets, property, and belongings should be distributed after their death. Under the Indian Succession Act, 1925, any person of sound mind and age above 18 years can create a valid Will.

While Will registration is not mandatory in India, having your Will registered at the Sub-Registrar's Office in Delhi provides significant legal advantages. A registered Will is difficult to challenge, tamper with, or suppress. It creates an official government record that stands as authentic proof of the testator's final intentions.

At Gaurav Documentation, we have been assisting Delhi NCR residents with Will drafting and registration since 1989. Our experienced para-legal team ensures your Will is clear, legally sound, and unambiguous — minimising the risk of family disputes or court challenges after your lifetime.

Why Will Registration Matters in Delhi NCR

🛡️

Prevents Tampering & Fraud

A registered Will is held in secure government custody, making it virtually impossible to alter, forge, or suppress by any party after the testator's death.

⚖️

Stronger Legal Standing

Courts in Delhi give greater evidentiary weight to registered Wills. Registration significantly reduces the risk of a successful legal challenge by disgruntled heirs or relatives.

👨‍👩‍👧‍👦

Prevents Family Disputes

Clear documentation of your wishes prevents misunderstandings, ensures fair distribution, and keeps family harmony intact when you are no longer around to clarify intent.

🏠

Protects Property Rights

Property owners in Delhi NCR with DDA flats, MCD properties, or builder floor apartments can ensure smooth title transfer without prolonged succession disputes.

👶

Safeguards Minor Children

A Will lets you appoint a legal guardian for minor children and create financial provisions for dependents who cannot manage assets independently.

📋

Bypasses Intestate Laws

Without a Will, assets are distributed under personal succession laws (Hindu Succession Act, Muslim Personal Law, etc.) which may not align with your wishes.

Will Registration Process in Delhi

Our streamlined 6-step process makes Will registration straightforward and hassle-free.

  1. Initial Consultation & Asset Inventory

We discuss your family structure, property holdings (DDA flats, MCD properties, bank accounts, investments), and your specific distribution wishes to understand the full picture.

  2. Will Drafting

Our experts prepare a clear, legally precise Will document reflecting your exact wishes. The draft is shared with you for review and any modifications before finalisation.

  3. Stamp Paper Procurement

A Will can be written on plain paper in India; however, we advise appropriate stamp paper based on your jurisdiction and value of assets to strengthen authenticity.

  4. Execution Before Witnesses

You sign the Will in the presence of two independent adult witnesses (who are not beneficiaries). Witnesses also sign confirming they saw you execute the Will voluntarily.

  5. Registration at Sub-Registrar Office

The testator personally presents the Will at the Sub-Registrar Office (along with witnesses and identity documents). The Will is registered and preserved in official records.

  6. Custody & Periodic Review

You receive certified copies for safekeeping. We recommend reviewing and updating your Will every 3–5 years or after significant life events such as births, deaths, or major asset changes.

Documents Required for Will Registration

Keep these documents ready before visiting the Sub-Registrar Office.

Testator's Photo ID Aadhaar Card, PAN Card, Passport, or Voter ID of the Will maker.

Address Proof Utility bill, Aadhaar, or any government-issued address proof of the testator.

Two Witnesses' ID Proofs Photo ID & address proof of both attesting witnesses (must not be beneficiaries).

Passport-size Photographs Recent photographs of the testator and both witnesses (2 copies each).

Drafted Will Document The final, signed Will on plain paper or appropriate stamp paper.

Property Documents (if applicable) Sale deed, allotment letter, or any title document for specifically mentioned immovable property.

Registration Fee Payment Nominal fee payable at the Sub-Registrar Office (currently ₹200 for Will registration in Delhi).

 Important Note

Will registration in Delhi requires the personal presence of the testator at the Sub-Registrar Office. Unlike other documents, a Will cannot be registered through a Power of Attorney. We coordinate your visit to ensure everything is handled smoothly.

Frequently Asked Questions: Will Registration in Delhi

Is Will registration mandatory in India?
No, registration is not legally mandatory for a Will to be valid under the Indian Succession Act, 1925. A properly witnessed unregistered Will is legally enforceable. However, registration at the Sub-Registrar Office provides strong additional benefits — it creates an official government record, prevents tampering, and substantially reduces the chances of a court challenge by any aggrieved party.
What is the cost of Will registration in Delhi?
The government registration fee for a Will at the Sub-Registrar Office in Delhi is currently ₹200 (subject to revision). No stamp duty is levied on Wills in Delhi. Our professional drafting and documentation assistance fee is charged separately and transparently communicated upfront during consultation.
Can I change or revoke my Will after registration?
Yes, absolutely. A Will can be modified at any time during the testator's lifetime. You may (a) execute a Codicil — a legal amendment that supplements the original Will, or (b) draft and register a completely new Will that revokes all previous Wills. Courts always recognise the most recently executed valid Will as the testator's final intent.
Who needs to be present at the Sub-Registrar Office for Will registration?
The testator (the person making the Will) must be personally present at the Sub-Registrar's Office. Both attesting witnesses are also required to be present and must present valid photo identification. Unlike most other documents, a Will cannot be registered through a Power of Attorney holder on behalf of the testator.
Can a Will be challenged in court even after registration?
While any Will can theoretically be challenged in a court of law, a registered Will is far harder to contest successfully. Common grounds for challenge — forgery, undue influence, lack of testamentary capacity — are significantly weakened by the official registration process, where the Sub-Registrar verifies the testator's identity and willingness at the time of registration.
What happens if I die without a Will (intestate) in Delhi?
In the absence of a Will, your estate is distributed according to applicable personal succession laws — the Hindu Succession Act 1956 for Hindus, Muslim Personal Law for Muslims, the Indian Succession Act for Christians, etc. This statutory distribution may not reflect your actual wishes, can take considerable time, and often leads to family disputes and litigation over property.
Can I include DDA or MCD property in my Will?
Yes. DDA allotted flats, MCD assessed properties, freehold plots, and builder floor apartments can all be bequeathed through a Will. However, the Will must be carefully drafted to align with DDA lease conditions, transfer rules, and applicable regulations. Our specialists are well-versed in DDA/MCD property documentation and can ensure your Will is fully compliant.
How long does the Will drafting and registration process take?
A straightforward Will can typically be drafted within 24–48 hours after our initial consultation. Registration at the Sub-Registrar Office is done at a mutually scheduled appointment — we help you coordinate and complete the process in a single visit, saving you time and multiple trips.
